our apartment building is up for foreclosure sheriff sale.landlord turn one apartment lights off.?

he is threatening to turn off all elec,water,&trash removal if we don’t pay him rent.since he longer own the building,what do we do to keep our utilities that included in our rent on?everyone is putting their rent in escrow account at their bank.in case we are told by the city to move immediately.

    As long as you have paid rent, you are legal able to be there… My advice would be to have a conversation with the landlord and inform him of your legal rights in your contract. Also inform him that if he does anything, then you will file a small claims suit against him and expect full reimbursement….. And if he has any braincells in his head, he will realize that he does not have a legal leg to stand an…

    Next, on the foreclosure… That is easy… File papers with the county (you can search on line for which ones)… Once you do this, it will take them at least 6 months to respond.. When they respond, you send a response in exactly 28 days (legal reasons)…. By doing this, you can easily live where you are at for 1 year with no rent… Pretty cool isnt it???

    The bank that owns the apartment buildings should be hiring an outside company to manage the place while proceedings are ongoing. You need to contact the actual lien holder and explain what’s going on. Remind them that they have a property with happy renters already in place and it’s harder to sell apartments if you have to fill them up after you’ve bought them.

    First of all you are legally required to pay the rent until the day you move out or the day the bank takes possession. That has NOT happened yet. He DOES still technically own it until the foreclosure process is finished. It is illegal to just put the rent in escrow. That MUST be court ordered FIRST!!

    He cannot just turn off the utilities though. That is constructive eviction and illegal. Even though he is going about this the wrong way, he is getting frustrated that you guys are illegally with holding rent.

    I suggest you guys pay the rent before you get an eviction on your record and cannot rent another place.

    EDIT: The bank will NOT talk to you!! They will have nothing to do with tenants before they legally have possession.

    According to you he DOES own it. He is entitled to the rent until after the sale takes place. No one has a legal right to withhold rent.

    The city will not force you to move, although you will owe for the late fees on your unpaid rent, since the withholding is illegal.

    Whoever organized this may face a huge lawsuit, he can be blamed for the foreclosure as he caused a huge amount of funds to be illegally withheld, funds needed to pay the mortgage. I would hope that they get some time behind bars as well, that was despicable.

    Banks are not allowed to evict apartment dwellers after foreclosure, they HAVE to hire a property manager, who will collect rent on the banks behalf.
